Terms of Service

Fog Hour is a San Francisco happy hour discovery service operated from California, USA ("Fog Hour," "we," "us"). By using foghour.app or any Fog Hour service, you agree to these terms. If you do not agree, do not use the service.
What Fog Hour is — and what the timestamp means
Fog Hour lists food and drink deals at bars and restaurants, each carrying a verification timestamp that records when the deal was last confirmed — by a menu photo, a community confirmation, staff review, or an editorial source. The timestamp is not a real-time guarantee. Menus change, kitchens close early, and a venue may decline to honor a listed deal at any time. If a deal matters to your plans — a large group, a special occasion, a long trip — call the venue first.
Fog Hour is not affiliated with the venues listed unless a listing is explicitly marked as venue-claimed. We are not responsible for a venue's prices, availability, service, or decision to honor or change any offer.
Eligibility
Fog Hour is not directed at children under 13, and you must be at least 13 to submit content or create an account. Much of the content on Fog Hour concerns alcoholic beverages; purchasing alcohol requires being of legal drinking age (21 in the United States), and nothing on Fog Hour is an offer to sell alcohol. Drink responsibly.
Your content
When you submit anything to Fog Hour — a deal, a menu photo, a description, a verification, a report — the following applies:
- You keep ownership. Your content remains yours.
- You give us a license. You grant Fog Hour a non-exclusive, royalty-free, worldwide, perpetual license to host, display, crop, compress, excerpt, and distribute that content in connection with operating and reasonably promoting the service (for example: the deal page, share cards, social posts). This license survives account deletion so the shared catalog stays intact, but deletion removes your name and contact details from it (see the Privacy Policy).
- You promise it's yours to share. Only submit photos you took or have the right to share, and information you believe to be accurate.
- It gets processed by AI and reviewed. Submissions are parsed by AI models to extract structured facts (items, prices, hours) and may be reviewed, edited for clarity, merged with other submissions about the same deal, or rejected by our operators.
We may remove any content at our discretion — for terms violations, inaccuracy, suspected impersonation, venue takedown requests, or copyright notices. Removal is not an admission of fault.
Acceptable use
You may not:
- Submit content you know to be false, including deals a venue does not offer.
- Impersonate a venue, its staff, or another person.
- Spam the submission, verification, or reporting surfaces, or circumvent rate limits by rotating devices, browsers, or network addresses.
- Scrape or bulk-harvest Fog Hour content, or use it to seed a competing catalog, without prior written permission. Linking to Fog Hour pages is always welcome.
- Interfere with the operation or security of the service.
Violations may result in rate limiting, content removal, account suspension, or — for conduct that is unlawful — referral to law enforcement.
Venue claims
If you claim a venue listing, you represent that you are authorized to act for that venue (owner, manager, or a delegated agent). A claimed venue's edits take precedence over community submissions for that venue. False claims are grounds for termination and may create liability to the venue harmed.
Termination
You can stop using Fog Hour at any time and can request account deletion as described in the Privacy Policy. We may suspend or terminate access for violations of these terms, with notice where reasonable.
Disclaimers and limitation of liability
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, availability, merchantability, and fitness for a particular purpose. To the fullest extent permitted by law, Fog Hour's total liability for any claim arising out of the service is limited to one hundred US dollars ($100). Fog Hour is not liable for indirect, incidental, special, or consequential damages, including any loss that follows from acting on a listed deal. Some jurisdictions do not allow certain limitations; where a limitation is not permitted, it applies to the fullest extent permitted.
Indemnity
If your content or your breach of these terms causes a third-party claim against Fog Hour, you agree to indemnify us for reasonable losses and costs arising from that claim.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in San Francisco County, California, and both parties consent to their jurisdiction.
Changes to these terms
We may update these terms. The effective date above always reflects the current version; material changes will be announced on the site before they take effect. Continued use after a change takes effect constitutes acceptance.
